Permanent Full Time Position is located in the Office of Litigation, Office of General Counsel, Office of the Secretary, U.S. Department of Transportation. The office provides advice and legal counsel for litigation in which the Department of Transportation is a party or has an interest. The Office oversees all Supreme Court cases and significant appellate cases involving the Department, supervises the preparation of all filings before independent regulatory agencies in proceedings in which the Department has an interest, and provides legal advice concerning litigation risk, and pre- and post-litigation policy decisions. The Office works with the Offices of the Chief Counsels of the various DOT operating administrations, which handle cases involving modal administration issues.
The ideal candidate will have strong skills in research, analysis, writing, editing, public speaking, and general policy making, with the ability to decipher and succinctly and clearly report on complicated factual and legal issues and to handle multiple projects, cases, and issues simultaneously. This position is located in the New DOT building, which sits directly across the street from the Navy Yard Metro station and blocks away from the National's baseball stadium. This is an Excepted Service position. As a Trial Attorney in the Office of the Assistant General Counsel for Litigation, you will:
Research relevant law and policy and prepare memoranda related to litigation in which DOT is a party or has an interest, draft or review pleadings, briefs, and other court filings, prepare or assist in preparation and presentation of oral arguments, prepare or coordinate litigation holds and discovery requests, and take and defend depositions or assist in taking or defending depositions.
Assist the Department of Justice in all phases of DOT's litigation, including the drafting of views letters and coordinating the work and participation of Departmental Chief Counsel's offices in such litigation.
Advise the General Counsel and the Chief Counsels of the Department's operating administrations on general questions of litigation policy, litigation risk and strategy, and issues in specific court proceedings and review for legal adequacy and vulnerability to judicial challenge proposed actions of all components of the Department.
Represent DOT in meetings with representatives of Federal and state government agencies and with high-level industry officials and maintain contacts with these and other high-level officials when needed; brief or assist in briefing high-level Department officials on significant cases.
In proceedings before independent Federal regulatory agencies, develop DOT's position and draft documents required in these proceedings, analyze documents submitted by other parties, represent DOT in hearings and oral arguments.
MANDATORY EDUCATION REQUIREMENT FOR ATTORNEYS:
Applicants must have a Law Degree (J.D. or equivalent) from an American Bar Association (ABA) accredited law school.
Must be an active member in good standing of the bar of the highest court of any state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

TRIAL PERIOD: This is an Excepted Service position. This job will be filled by an alternative hiring process and is not in the competitive service. Applicants selected for an excepted service position may be subject to a two-year trial period.

To qualify for the Grade 12:
You must have education or experience equal or equivalent to:
A law degree, bar membership and either two years of professional attorney experience or a second professional law degree (LL.M.) which requires one full year of graduate study.
To qualify for the Grade 13:
You must have education and experience equal or equivalent to:
A law degree, bar membership and either three years of professional attorney experience or one year of professional attorney experience and a second professional law degree (LL.M) which requires one full year of graduate study.

The check will bounce and the victim is left responsible.
