THE SELECTION CERTIFICATES MAY BE SHARED AMONG PROGRAM OFFICES ACROSS THE DEPARTMENT OF EDUCATION Permanent Full time The Department of Education's (ED) Office of General Counsel (OGC) provides legal services in support of the Department's mission to promote student achievement and prepare students for global competitiveness by fostering educational excellence and ensuring equal access to education. The Division of Postsecondary Education (DPE) is one of seven Divisions within OGC and provides legal counsel and representation in a variety of practice areas including: Federal Student Aid program, commercial law, debtor-creditor law, administrative law, and constitutional law. You must be a U.S. Citizen. Must complete a Background Investigation and fingerprint check. Relocation Expenses will not be paid. An attorney filling this position will be involved in implementation, accountability, and enforcement activities under the Federal Student Aid (FSA) programs, which provide financial assistance to individuals pursuing education after high school. Legal work on these programs regularly requires reference not only to program statutes but to commercial law and administrative law. The work involves advising Department clients in the DPE practice areas, which include corporate and financial transactions, accreditation, and debtor-creditor law, and assisting with the formulation of regulations, other guidance to program participants, and proposed legislation. The DPE practice areas also include participation in the conduct of court and administrative litigation, such as False Claims Act cases, lawsuits challenging Department regulations or other actions as arbitrary and capricious, and appeals of liability determinations to the Department's administrative adjudication office. Both the advisory work and the litigation work require frequent consultation and coordination with other Federal agencies and with State agencies. You must be a graduate from a law school accredited by the American Bar Association and be a member in good standing of a Bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. You must be a U.S. citizen to qualify for this position. Applicants must have:
(1) Law degree from accredited law school by American Bar Association;
(2) active (good standing) bar membership;
(3) Experience in providing legal advice, counsel and representation in one or more of the areas referenced in the Major Duties section of this announcement;
(4) Knowledge of government-wide statutes, rules, and regulations applicable to the DPE practice areas;
(5) Experience representing clients in litigation; and
(6) Excellent interpersonal skills;

Basic Requirements:
You must be a graduate from a law school accredited by the American Bar Association.
Proof of admission to the Bar of the highest court of a state, territory, the District of Columbia, or the Commonwealth of Puerto Rico; and current membership in such Bar as would permit the practice of law. You must be a member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.

Professional Legal Experience Requirement:
Applicants must have the year(s) of professional legal experience as shown below.
For Appointment at the GS-13 level, the following qualification requirements are needed: Three (3) years of professional legal experience. You must have one year of specialized experience at a level close to the work of this job that has given you the particular knowledge, skills and abilities required to successfully perform. Typically, we would find this experience in work within this field, and/or complex legal work, including extensive research, analysis, evaluation and/or litigation in a legal specialization relevant to the duties and responsibilities of the position. This experience must be equivalent to the duties of a GS-12 attorney in the Federal service.
For Appointment at the GS-14 level, the following qualification requirements are needed: Four (4) years of professional legal experience. You must have one year of specialized experience at a level close to the work of this job that has given you the particular knowledge, skills and abilities required to successfully perform. Typically, we would find this experience in work within this field and/or complex legal work including, extensive research, analysis, evaluation and/or litigation in a legal specialization relevant to the duties and responsibilities of the position. This experience must be equivalent to the duties of a GS-13 attorney in the Federal service.

The successful candidate must have demonstrated ability to provide high quality legal advice and counsel on issues arising in the areas referenced under Major Duties above. The fraudster will send a check to the victim who has accepted a job. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
